"Company" means LIVELITE LIGHTING HIRE & SALES LTD, THEATRE LIGHTING LTD or LIVELITE GROUP LTD t/a Livelite
"Customer" means the person / firm / company hiring goods from the Company.
"Equipment" means products or services which the Company agrees to supply to the Customer.
Hire charges are calculated at the prevailing rates set out in the
current hire list and are for equipment only. Value Added Tax if applicable will be added to the Hire charge at the rate in force at the invoice tax point date. All hire charges are due and payable in advance unless account
facilities have been prior agreed. Hire charges shall be for a period
of one or more days or weeks, or any other period as the Company may agree to, irrespective of whether the goods are
in use or not. Customers retaining the equipment after the hire period
has expired, render themselves liable to additional charges. All prices and price lists may be changed without notice.
The equipment hired must not be taken outside the United Kingdom
without prior written consent of The Company.
Equipment hired will be entirely at the Customers risk during the hire
period and Customers will be responsible for any loss or damage thereto
howsoever arising. The Customers liability under this condition commences
on delivery to the Customers vehicle, or to the address specified by the
customer.
Customers shall be responsible for ensuring that any relevant
regulations, rules or statutory provisions governing, or related to,
the use of hired equipment are complied with during the period of hire
and The Company in no way assumes liability for the
consequence of any non-compliance with any such regulation.
Equipment will be supplied to The Customer in normal working order. The Company liability for any defect in, or failure of the
equipment hired is limited to the rectification of any defect or
failure arising from normal wear and tear.
The Company will not be liable for any loss or damage
sustained by the Customer consequential to any defect or failure of the
equipment hired.
The Customer undertakes responsibility for insuring all equipment against
"all risks" to full replacement value.
The Company expects all hired equipment to be
installed by a competent electrician. The Company will
not be liable for any damage to property or personnel whilst the
equipment is on hire.
Equipment hired must not be modified or altered in any way and in
particular cables must not be cut and the wiring of plugs and sockets
must be returned as delivered. Any equipment found to be modified, or
altered, any missing bulbs or components and any cables found to be
cut or modified will be charged to The Customer account at full
replacement cost. All cables must be returned neatly coiled and taped
or tied. Failure to do so may result in a charge to The Customer
account.
ANY DAMAGE TO, OR FAILURE OF, OR DEFECT IN, THE HIRED EQUIPMENT MUST
BE NOTIFIED TO THE COMPANY WITHIN 24 HOURS OF ITS OCCURRENCE
AND CONFIRMED IN WRITING. IN DEFAULT, THE CUSTOMER WILL BE CHARGED WITH
THE COST OF REPAIR OR REPLACEMENT. THE CUSTOMER ASSUMES RESPONSIBILITY
FOR THE REPLACEMENT OF LAMPS EXCEPT IN THE CASE OF AN ELECTRICAL
FAILURE. ALL FAULTY LAMPS MUST BE RETURNED FOR INSPECTION, OTHERWISE
THEY WILL BE CHARGED TO THE CUSTOMERS ACCOUNT.
All equipment hired, including any consumables such as filter, remains
the absolute property of the Company.
The Customer grants that any representative of the Company has the right to entry upon any premises where the goods may
be, to repossess, examine, repair, or service the equipment.
In the event of cancellation of order, The Customer must give a minimum
of forty eight hours notice to the hire order office. Failure to do so
will result in one weeks hire charge being made to The Customer
account.
These conditions are the only conditions of the contract under which the Company supplies equipment. All other conditions which the Customer attempts or purports to impose shall be excluded from any contract between the parties.
Waiver of all or any of these conditions by the Company shall not effect or prejudice its rights and remedies in respect of any subsequent breach, non-performance or non-observance.
These conditions are personal to the Customer and are not capable of being assigned without the Company prior written consent.
These conditions shall in all respects be governed by the law of England and the Customer agrees to submit to the non-exclusive jurisdiction of the English courts.
